Terms of Service

Installing BackBy means you (the "Merchant") accept these terms. BackBy is operated by 8th Origin LLC.

The service

BackBy is a Shopify app that captures back-in-stock email signups on sold-out product variants and, when Shopify reports the variant back in stock, sends each waiting shopper one back-in-stock notification email on the Merchant's behalf. That notification is the only email BackBy sends to captured shoppers; the Merchant may instead export the list and send notifications through their own email provider.

Plans

The free plan includes up to 30 lifetime captured emails; above the cap, new signups are still captured but their addresses are locked until upgrade. Capture and automatic back-in-stock notification are included on every plan. The paid plan removes the cap, adds CSV export, removes the "powered by BackBy" attribution, and includes a free trial. Current pricing is shown on the app's Billing page and the App Store listing. The lifetime counter is monotonic — it never decreases, even when entries are deleted or exported.

Billing

Billing runs through the Shopify Billing API and appears on the Merchant's Shopify bill. Cancellation is one click from the BackBy Billing page or by uninstalling the app. Refunds for the unused portion of the current billing cycle are available on request.

Acceptable use

• Don't use BackBy to capture emails for products you don't have the right to sell.
• Don't use BackBy in any phishing, scam, or impersonation operation.
• Don't capture emails on storefronts that are not your own Shopify shop.
• Don't reverse-engineer, abuse, or attack the BackBy service.

We may suspend access (with notice and a chance to cure) on credible reports of misuse.

Data ownership

Captured emails belong to the Merchant; we process them as the Merchant's data processor per the Privacy Policy. BackBy sends the back-in-stock notification on the Merchant's behalf to shoppers who requested it; the Merchant remains responsible for complying with applicable email-marketing laws (CAN-SPAM, GDPR, CASL) for any further use of the captured list. We will not sell, rent, or share captured emails with any third party other than the Merchant.

Availability

We aim to keep BackBy available at all times but are not liable for downtime caused by Shopify, our hosting or database providers, or other upstream services.

Liability

To the extent allowed by law, BackBy's liability to the Merchant for any claim is capped at the amount the Merchant paid us in the 12 months before the claim. BackBy is provided "as is."

Termination

Either party may terminate at any time — cancel the subscription or uninstall the app. On uninstall, BackBy wipes the Merchant's data per Shopify's shop/redact requirement.

Changes

Material changes to these terms are announced to installed merchants before taking effect.

Governing law

These terms are governed by the laws of the State of Delaware, US. Disputes go to the state and federal courts in Delaware.
